WinView Technology, Inc. Files Lawsuits Against FanDuel and DraftKings for Patent Infringement
WinView Technology, Inc. has taken legal action against two major sports wagering companies in the United States, FanDuel and DraftKings, by filing patent infringement complaints against them. The lawsuits were filed in the District of New Jersey, accusing the operators of incorporating WinView’s proprietary technology without authorization into their platforms offering online casino games, Daily Fantasy Sports, micro-betting, and live in-play wagering.
The Allegations
WinView, a leading developer of real-time interactive betting and mobile gaming, claims that FanDuel and DraftKings have violated nine of its patents. These patents cover methods and systems for enhancing real-time interaction in online sports gaming through ultra-low-latency streaming and skill-based gaming features that could significantly improve their current offerings.
According to WinView, the company initially approached FanDuel and DraftKings with alternative solutions to resolve the copyright infringement issue, such as a partnership or investor agreement. However, Dave Lockton, WinView’s founder and executive chairman, stated that legal action became necessary as the operators continued to use their patented technology without permission despite ongoing discussions.

The two operators are accused of violating US Patent Nos. 11,185,770, 11,235,237, 11,338,189, 11,451,883, 11,678,020, 11,736,771, 11,918,880, 11,951,402, and 12,005,349. WinView’s legal team, led by Paul Andre, co-chair of the company’s patent litigation practice, is seeking an injunction to halt further usage of their technology and will pursue damages.
Previous Legal Actions
This is not WinView’s first encounter with DraftKings in court. In 2021, the company filed a patent infringement suit against DraftKings, alleging the unauthorized use of their technology for synchronizing system latencies in skill-based games and managing client resources on computing devices. The previous case involved US Patent Nos. 9,878,243 and 10,721,543.
Although the Patent Trial and Appeal Board invalidated 34 out of WinView’s 245 claims related to the previous lawsuit in January, the company remains optimistic about the current legal proceedings. If successful, WinView’s lawsuits could have significant implications for the sports betting and Daily Fantasy Sports industries.
