Former Executive Settles Lawsuit Against New York State-Owned Casino
A former executive at a New York state-owned racetrack and casino has recently settled a prolonged lawsuit after testifying against his employer and subsequently being terminated from his position. The legal battle involved Michael Nolan and the Western Regional Off-Track Betting Corp (WROTB), a publicly owned casino and racetrack.
Allegations of Harassment and Unlawful Termination
In April 2019, an investigative report revealed that the FBI was investigating suspicious contracts between OTB and companies connected to politicians. Some of these businesses were allegedly linked to Henry Wojtaszek, the CEO of OTB at the time and a prominent figure in the Niagara County GOP. The federal authorities were also interested in contracts associated with OTB’s former chairman, Richard Bianchi, who was leading the Monroe County Republican Party.
Michael Nolan was approached by the FBI to cooperate with the investigation into OTB’s activities. However, when he informed his superiors, Wojtaszek and Bianchi, about his cooperation with the federal authorities, Nolan claimed he faced harassment in the workplace. His attorney, Steven Cohen, described the treatment Nolan endured as “a living hell,” including being forced to work on weekends, having his responsibilities reduced, losing health insurance, and being denied a pay raise.
Settlement Reached in Lawsuit
After enduring months of harassment, Nolan was ultimately terminated from his position at OTB. Subsequently, he filed a lawsuit alleging wrongful termination and harassment. Nolan highlighted that he is protected by laws that safeguard whistleblowers against retaliation.
In response to Nolan’s lawsuit, OTB filed a counterclaim, accusing the former executive of engaging in a “public smear campaign” that harmed the casino’s reputation. However, after several years of legal battles, a settlement was reached last month. OTB agreed to pay $550,000 to resolve the wrongful termination lawsuit.
It’s important to note that neither OTB nor Nolan admitted any wrongdoing as part of the settlement agreement. According to John Owens, OTB’s attorney, the operator will contribute $150,000 towards the settlement, with the remainder covered by OTB’s insurance company.
This settlement marks the end of a contentious legal dispute that shed light on allegations of misconduct and wrongful termination at the New York state-owned casino. The resolution provides closure for both parties involved in the case.
